APPEALS COURT VINDICATES RAFI KHAN'S POSITION

 LOS ANGELES, Aug. 27 /PRNewswire/ -- The United States Court of Appeals for the Second Circuit has vacated a preliminary injunction issued by the District Court in connection with Rafi Khan's effort to replace the board of directors of ICN Pharmaceuticals Inc. Khan called the ruling "a complete vindication of his position," and stated that he "intended to proceed with his efforts to unseat the current ICN board."
 The Court of Appeals ruled in favor of Khan with respect to all three issues that Khan raised on appeal. First, the Court ruled that the permanent injunction issued by the District Court against Khan was improper. Second, the Court found that the requirement imposed by the District Court that any SEC filings by Khan be precleared with the District Court and ICN was inappropriate. Third, the Court vacated the District Court's finding that Khan had committed perjury.
