``It's very significant,'' Smith's attorney, Kent Richland, said of Monday's ruling.

``She was very excited and appreciative of what the Supreme Court did,'' he said.

Smith was a 26-year-old Houston stripper still going by her given name of Vickie Lynn Hogan when she married Marshall, then an 89-year-old oil tycoon worth about $1.6 billion, in 1994.

Marshall died after 14 months of marriage, triggering an inheritance war between his son and Smith.

Although Marshall did not include Smith in his will, she claimed she was promised half her husband's fortune.
