ALPHA 1 PREVAILS IN LAWSUIT

BETHESDA, Md., Oct. 8 /PRNewswire/ -- Alpha 1 Biomedicals, Inc. (NASDAQ: ALBM), announced today the denial by the U.S. District Court for the Northern District of California of a motion for a preliminary injunction filed by SciClone Pharmaceuticals, Inc., in a suit initiated by SciClone.
In reacting to the court's finding that the relief requested by SciClone was not warranted, Dr. Vincent Simmon, the president and chief executive officer of Alpha 1, stated that the company was gratified by the ruling. According to Dr. Simmon, "The decision of the court reinforces Alpha 1's belief that the claims made by SciClone that Alpha 1 was in breach of the license agreement are completely lacking in merit. SciClone had falsely claimed that Alpha 1 had failed to provide SciClone with assurances of Thymosin alpha 1 sufficient to meet its commercial needs. We believe that SciClone's unsuccessful effort to secure injunctive relief was nothing more than a diversionary tactic designed to distract attention from the claims lodged against SciClone in the arbitration proceeding initiated by Alpha 1." The court's ruling has the effect of restoring the arbitration proceeding as the appropriate forum for resolving each of the parties' respective claims.
Alpha 1 Biomedicals, Inc., is engaged in the development of pharmaceutical products for the treatment of chronic viral diseases, immune disorders and cancer. The company's lead drug, Thymosin alpha 1, is currently in U.S. clinical trials for the treatment of chronic hepatitis B, chronic hepatitis C and AIDS.
