ALLEGHENY LUDLUM: PATENT REJECTED BY U.S. PATENT AND TRADEMARK OFFICE
PITTSBURGH, Nov. 7 /PRNewswire/ -- Allegheny Ludlum Corporation (NYSE: ALS) today announced that the United States Patent and Trademark Office, in reexamination proceedings, rejected the patent that had been the subject of its lawsuit against Nippon Steel Corporation concerning a process for manufacturing grain-oriented silicon electrical steel.
In April 1991, Allegheny Ludlum announced settlement of the patent infringement lawsuit. Under the terms of the settlement agreement, Nippon paid Allegheny Ludlum $5 million on May 15, 1991. Allegheny Ludlum was to receive an additional $5 million contingent upon the outcome of the reexamination proceedings then pending in the United States Patent and Trademark Office.
Allegheny Ludlum has been given two months to appeal the decision which it is reviewing. The company expects to file an appeal.
