ALARCON RESCINDS MOTION THAT COULD HAVE AIDED WIFE.

Byline: KERRY CAVANAUGH

Staff Writer

After reports that a street-classification change introduced by Councilman Richard Alarcon could help his wife's development plans, the veteran councilman said Tuesday that he is rescinding the proposal to "eliminate any perception of favoritism."

Alarcon married Flora Montes de Oca Montes de Oca is the name of the 15th canton in the province of San José in Costa Rica. The canton covers an area of 15.16 km²[1], and has a population of 53,357[2]. The capital city of the canton is San Pedro.  on Saturday in Studio City. The couple now lives in her small home on Wakefield Avenue in Panorama City, which Montes de Oca plans to develop into nine single-family homes.

But the Los Angeles Times Los Angeles Times

reported Saturday that Alarcon introduced a motion in June seeking to downgrade Downgrade

 to a local street.

The change would mean Montes de Oca wouldn't have to give up 2,850 square feet of her lot to widen the street when she develops the property.

While the motion may not have been a conflict of interest while Montes de Oca was Alarcon's girlfriend or fiancee, state law prohibits officials from making decisions on property owned by their spouses.

Alarcon initially said he would recuse To disqualify or remove oneself as a judge over a particular proceeding because of one's conflict of interest. Recusal, or the judge's act of disqualifying himself or herself from presiding over a proceeding, is based on the Maxim  himself from voting on the motion after the couple married. But in a statement Tuesday, he said he would entirely withdraw the proposal.

"Irrespective of irrespective of

the truth of the matter, I am rescinding the motion so as to eliminate any perception of favoritism, as I reside on Wakefield Avenue in property that has been owned by my wife, whom I married last Saturday, for over eight years," he said.

He added that the motion would have made the width of the street consistent with the community plan and the residential character of the neighborhood.

But his aides said no council colleagues would reintroduce Re`in`tro`duce´

Alarcon had tried to move into his wife's newer, larger house while the Wakefield property is being developed. But that house is in Councilwoman Wendy Greuel's district, and she does not support redrawing district boundaries.
