AIRPORT LAWSUIT MOVES AHEAD.

BURBANK - The City Council will proceed with an amended lawsuit challenging Measure A, and also will pay for supporters of the voter-approved initiative to intervene in the litigation An action brought in court to enforce a particular right. The act or process of bringing a lawsuit in and of itself; a judicial contest; any dispute.

Councilwoman Marsha Ramos had asked that the council reconsider its vote to file the suit, then cast the deciding vote late Tuesday to continue the litigation.

The suit has been amended to focus on overturning only portions of the measure deemed illegal, rather than the entire initiative. Ramos was joined in her support for the suit by Councilmen David Golonski and David Laurell.

``We the council are placed in an untenable position. We have enforcement issues and interpretational issues to deal with,'' Ramos said.

The council also set aside $100,000 to pay for legal costs for a Measure A supporter to intervene in the court case. It promised to increase the funding if more is needed. Councilwoman Stacey Murphy, who voted against the suit, sided with Ramos, Golonski and Laurell to approve the funding.

Critics say the city's lawsuit is a sham False; without substance.

``It's my hope that both sides are represented,'' Ramos said.

City officials plan to advertise and to send letters to proponents of the initiative interested in intervening in the case. Interested parties are asked to submit a statement to the City Attorney's Office by noon Nov. 26.

Based on interviews and statements, the council will decide who to fund at its Nov. 27 meeting.

``(City officials) are trying to hand-select a person so they can control the defense as well as the attack on Measure A,'' said Ted McConkey, who helped launch the initiative. ``What they should be doing is defending the thing.''

McConkey said he would not apply for the funding, nor would Howard Rothenbach, chairman of Restore Our Airport Rights, a grass-roots group that placed the initiative on the ballot.

, the Airport Authority has filed court papers to dismiss the city's lawsuit on the basis that the city sued the wrong party.

``Rather than facing the political costs of suing some of its own voters, the city improperly sued the wrong defendant - the airport authority,'' the authority's court papers claimed.
