AGUA DULCE AIR PARK CLEARED FOR EXPANSION COUNTY COUNSEL ISSUES NEW RULES.

 - County legal experts have agreed on rules for the Agua Dulce Air Park, ending months of bitter controversy over the recently revamped property, and paving the way for the airport to expand.

Friday, Deputy County Counsel Judith Fries distributed a set of guidelines guidelines,

``The county counsel has issued an opinion that should answer the concerns surrounding the permits required for the Agua Dulce Air Park,'' said Paul Novak, planning deputy for Supervisor Michael D. Antonovich Michael Dennis Antonovich (born 1939 in Los Angeles, California) is a member of the Los Angeles County Board of Supervisors representing the Fifth District, which covers northern Los Angeles County, the Antelope, Santa Clarita, Pasadena, and parts of the San Fernando and San . ``Our office looks forward to working with the Agua Dulce Town Council to further address these issues.''

Both airport owner Barry Kirshner and the lawyer representing residents opposed to Kirshner's plans have hailed the counsel decision as a fair compromise, which requires conditional use permits for several of the airport's peripheral operations.

``(We have) determined that various activities have occurred on the air park property or have been proposed by the property owner that are prohibited or require further zoning approval,'' according to according to

According to the counsel decision, the airport will be allowed to house as many airplanes as it can fit, in accordance with Special Permit 1404 that was passed by the Board of Supervisors in 1960.

The airport is also within the rules in continuing with plans to build a motel and swimming pool, so long as Kirshner applies for a revised site plan.

Kirshner will not, however, be allowed to open a membership-only sports club A sports club, athletics club or sports association is an eclectic institution oriented to multiple sports, which fields many teams and has varied sports departments in several sports, working under the same umbrella organization.  on the property, nor build a soccer field, without getting conditional use permits.

The use permit application process requires public hearings.

Several of the other proposed uses of the property - such as holiday events and movie filmings - will be allowed on a temporary approval basis.

Kirshner was pleased with the county's decision, which he said reinforced his understanding of the airport's land use permits.

``I'm really happy with the way this came out. We didn't know we needed a (conditional use permit) to sell memberships, but now I know and we will,'' Kirshner said.

In another victory for Kirshner, the airport was found to be free of any Federal Aviation Administration Federal Aviation Administration (FAA), component of the U.S. Department of Transportation that sets standards for the air-worthiness of all civilian aircraft, inspects and licenses them, and regulates civilian and military air traffic through its air traffic control  violations, and an investigation into possible misconduct was closed earlier this month.

Jeremy Schuster, a lawyer hired by an upset airport neighbor, was satisfied with the conclusions made by Fries.

He said Fries' letter addressed ``the litany litany (lĭt`ənē) [Gr.,=prayer], solemn prayer characterized by varying petitions with set responses. The term is mainly used for Christian forms. Litanies were developed in Christendom for use in processions.  of items that I brought to Supervisor Antonovich's attention.''

``The residents that I've talked to feel that they have been powerless in addressing these issues. By being forced to retain (conditional use permits), the concerns of the residents will be addressed,'' Schuster said.
