The revisions amend the existing regulations by clarifying that aluminum diecasters, foundries and extruders that melt only clean charge, customer returns and internal scrap, and that do not operate a sweat furnace, chip dryer or delacquering kiln are not "secondary aluminum producers" or subject to regulation under this rule. Since the revisions issued in December were consistent with the settlement agreement, the industry and U.S. EPA have jointly stipulated to voluntarily dismiss the legal challenge. "This interdependent teamwork by AFS, NADCA and NFFS has produced positive results for the aluminum sector of the U.S. metalcasting industry," said Dwight Barnhard, AFS executive vice president. In announcing the dismissal, a spokesperson for the collective effort of the three metalcasting associations said, "The industry's collective effort saves aluminum foundries and diecasters thousands of dollars in needless administrative and compliance changes and ensures that the industry's and EPA's scarce resources are applied where they are most needed, and where they will provide the biggest 'bang for the buck."'
