A report in The FT, quoting senior Pakistani and Arab officials,

Argentina Australia believe this is the first time Bin Laden makes such an order
and say it comes as a direct reaction to Pres. Bush's decision to
allow military rather than civilian courts to try suspected terrorists).
A Pakistani official said: "While offering themselves to die for a
cause was considered vital, now Osama Bin Laden is formally telling his
followers to only opt for death. His instructions are that death or
victory are the only options". An Arab diplomat said: "Bin
Laden now seems to believe that the rope is tightening around his neck.
His response is to argue that a trial in the US would be so unpleasant
that it's much better for his followers to die".
