ADVISORY/Hersh & Hersh Begins Trial Today Against Los Gatos Motor Inn; Motel Denies Responsibility for Insufficient Security That Resulted in Sexual Assault on Guest.

News Editors/Legal Writers

ADVISORY...for Tuesday Tuesday: see week.  (Aug. 26)

--(BUSINESS WIRE)

Who: San Francisco plaintiff rights law firm Hersh & Hersh's
case against the Los Gatos Motor Inn will proceed to trial
today. The case, on behalf of Hersh & Hersh's client who
was raped while staying at the motel in February 2002,
argues the motel is culpable in not taking proper security
measures that could have deterred the guest's attacker.

What: Hersh & Hersh's lawsuit against the Los Gatos Motor Inn,
located at 550 Los Gatos-Saratoga Road, charges that the
motel was negligent and should have provided security
devices to minimize the risk of intrusion into the guest's
            motel room.
This case also serves as a reminder to women traveling
alone to carefully check and ensure that motel operators
have taken proper steps to ensure their safety.

Why: The plaintiff, whose name has been withheld to protect her
privacy, responded to a knock on her door at night and was
subsequently assaulted and raped. At the time the guest
was attacked the motel did not provide in-room security
devices such as a door viewer or security peephole, nor
did owners provide a nighttime security guard to patrol
the open walkway leading to motel rooms.

Where: The jury trial begins today at 8:45 a.m. at the Santa
Clara County Superior Court of California with Judge Jaime
Jacobs-May, Department 4, presiding. The trial is expected
            to last two weeks.
