What:        Seven legendary surfers from the 1960s will face
             Abercrombie & Fitch in court on Tuesday.

Why:         In Abercrombie & Fitch's "Spring Fever" catalog issued in
             1999, a photograph of 13 legendary surfers - including
             their names - was included in the catalog without their
             notification or permission.

             Led by George Downing, seven of the individuals filed a
             complaint in 1999 in the United States District Court,
             Central District of California, alleging the company was
             commercially exploiting their names and likeness for the
             purpose of marketing its products. Early on in the case,
             Judge Manual Real granted summary judgment in favor of
             Abercrombie & Fitch on several grounds, including the
             First Amendment right to free speech. However, in
             September 2001, the Ninth Circuit Court of Appeals
             overruled Judge Real's decision, and the new trial begins
             tomorrow.

             Paul Strauch, Rick Steere, Richard (Buffalo) Keaulana and
             Ben Aipa, all represented by Brent Blakely, an attorney
