WHAT: Bayside District Corporation will be added as a party in nine
Government Claims for Damages that Greene, Broillet, Panish &
Wheeler, LLP will file against the City of Santa Monica on
January 14, 2004 as a consequence of the Santa Monica
Farmers' Market tragedy. At 10:00 AM on that date, the firm
will hold a press conference at Santa Monica City Hall and
will detail specific allegations contained in the Claims.
Both injured victims and family members of those who were
killed will participate in the press conference.
Greene, Broillet represents Benny Gong, Ilona Lettrich, Dina
Richter, Holley Hankinson, Olivia Wun and Sandra Ellen Bacal,
who were all injured in the July 16, 2003 Santa Monica
Farmers' Market tragedy. The firm also represents the Estate
of Diana Gong McCarthy, the Estate of Kevin McCarthy, and the
Estate of Leroy Lattier.

deceased brother, Leroy Lattier.

NOTE: The filing of a Government Claim for Damages is a mandatory
first step as required by California law before a civil suit
can be filed against a governmental entity. If the
governmental entity denies the claim, which is usually the
case in matters of this magnitude, a civil lawsuit against it
can then be filed in Superior Court. This must be done within
six months of the incident or a potential claimant may be
barred from filing such a claim. In this particular instance,
the deadline is January 16, 2004 to file against the City and
other governmental entities. On the other hand, there is a
two-year statute of limitations for filing a personal injury
or wrongful death claim against an individual or
non-governmental entity.
