The lawsuit also alleges that based on a course of conduct approved by Mr. Glass, Wal-Mart is liable to AMG for misrepresentation, deceptive trade practices, injurious falsehood, and intentional interference with contractual relationships and business expectancies. The lawsuit also includes a claim for damages under the doctrine of "promissory estoppel."

The civil complaint alleges that AMG has suffered substantial damages as a consequence of the conduct of Wal-Mart, as alleged in the lawsuit. The civil complaint does not, however, refer to a specific dollar amount of damages which AMG seeks to recover from Wal-Mart in the lawsuit.

Charles H. Hood, President of AMG stated, "As evidenced by Wal-Mart's own internal research, the Shoppers Calculator program was a huge success for Wal-Mart, its vendors, and its customers. We were therefore shocked and disappointed when Wal-Mart notified us in April of 1998 that it had decided to discontinue the Shoppers Calculator program. While we clearly would have preferred to continue our business relationship with Wal-Mart, the recent events that are described in the lawsuit left us with no choice but to take legal action to recover our damages and protect our shareholders."
