ACTOR RECEIVES 6-YEAR TERM FOR MOLESTING GIRL.

Byline: Michael Coit Daily News Staff Writer

Television and movie actor Maurice Elias, better known as James Stacy, was sentenced Tuesday to six years in state prison for molesting an 11-year-old girl at his Ojai area home in March 1995.

The 59-year-old Elias admitted in Ventura Superior Court last fall to molesting the girl and to a misdemeanor prowling prowl

charge, which prosecutors said also was related to a young girl. But he failed to appear at the December sentencing hearing and turned up in a Honolulu hospital after attempting suicide.

At Tuesday's hearing, Elias apologized for the molestation molestation n. the crime of sexual acts with children up to the age of 18, including touching of private parts, exposure of genitalia, taking of pornographic pictures, rape, inducement of sexual acts with the molester or with other children, and variations of these  incident.

"I hope it didn't interrupt her innocent mind," he said of the victim, who did not appear at the hearing. "I'm sorry also to her mother for causing her this pain."

The prosecutor argued that Elias was attempting to manipulate the court to gain probation much like his attempts to bribe BRIBE, crim. law. "The defendant has demonstrated that he is a danger to the community, that he has a propensity to act out sexually towards children," said Deputy District Attorney Dee Corona Corona, city, United States

Elias faced a maximum prison term of eight years. Superior Court Judge Steven Hintz agreed with the prosecutor's recommendation for the six-year term, and also sentenced Elias to 150 days on the prowling conviction with that time included within the longer sentence.

The sentence pleased the mother of the girl Elias admitted molesting, and prompted members of Elias' family to leave the third-floor courtroom sobbing.

"I feel justice has been served. My daughter just wanted this man in jail," said the girl's mother.

Elias' acting career spanned several decades. He had a recurring role in "The Adventures of Ozzie and Harriet Ozzie and Harriet

His acting became more limited following a 1973 motorcycle accident in which Elias lost his left arm and left leg. Elias was riding on a motorcycle with a friend when they were hit by a car driven by a drunk driver. Elias knew the family of the girl he admitted molesting. The prosecutor said Elias invited the girl to his pool several times in March of last year and molested mo·lest

The mother said her daughter told her about the incident within a few hours after it occurred. After reporting the incident to authorities, the mother said Elias offered her $2,500 for therapy to help her daughter recover. The prosecutor said that was a bribe to keep the family from cooperating with the investigation.

Prosecutors also charged Elias with prowling at the homes of two other young girls whose families lived in the Ojai area. One of the charges was dropped when Elias pleaded guilty last year.

Defense attorney Sam Eaton sought probation, contending that the incident was "minimal molestation" that was brief and ended when Elias realized it was wrong.

Eaton said Elias suffers from psychological problems resulting from brain damage and the loss of his two limbs following the motorcycle accident. Eaton said the problems "affect his judgment in terms of inappropriate behavior" and that Elias was lonely, depressed and looking for Looking for

The judge did not agree with Eaton's argument: "I do not think that your celebrity or your injuries or your alcohol problems are mitigating factors," Hintz said.
