Unfortunately, the appeals court refused to consider any friend-of-the-court brief in the matter - including our brief representing 17 members of Congress. The hostility of this appeals court is absurd and underscores faulty conclusions that must not stand. We will work aggressively in representing members of Congress and citizens from around the country in asking the Supreme Court to take this case. We're hopeful the high court will take the opportunity to address this most important issue and eventually uphold the phrase 'One nation under God' in the Pledge of Allegiance." In a decision today, the 9th U.S. Circuit Court of Appeals let stand a decision by a three-judge panel issued last June declaring the phrase unconstitutional. The ACLJ says it will represent itself, members of Congress, and citizens from around the country in its brief to be filed with the Supreme Court asking the high court to consider the case. Sekulow says the ACLJ will begin a nationwide campaign to generate public support for the Pledge and will work to add thousands of names of citizens to the petition to be filed with the high court.
