Jesse Lee Jesse Lee (1758-1816) was an American Methodist Episcopal clergyman and pioneer, born in Prince George's County, Va. ``He was suspicious that there was another guy over there. He confronted the guy at the location and there was a scuffle,'' prosecutor Guy Shirley said.

After the defendant's other sister got involved in the dispute, Kerr fired a .45-caliber pistol. A single bullet struck the sister who intervened, in the arm and Zapata in the head, Shirley said.

``It's not clear who got hit first. It was through-and-through (wounds) on both,'' Shirley said. ``The sister testified, and she couldn't tell whether the bullet hit her first.''

Kerr's attorney could not be reached for comment. Shirley said the defense is arguing that the gun discharged accidentally.

Kerr has pleaded not guilty and is being held in lieu of Instead of; in place of; in substitution of. It does not mean in addition to.  $950,000 bail.

The shooting was reported about 1:40 a.m. in the Marbella Villas complex in the 43400 block of 30th Street West, sheriff's deputies said.

The sister was wounded was treated at a hospital and released.

Several people were in the condo when the shooting occurred, and told detectives conflicting stories about what happened, officials said.
