A new generation of defendants.


Longtime asbestos attorney Alwyn Luckey of Ocean Springs, Mississippi Ocean Springs is a city in Jackson County, Mississippi (USA), about 2 miles east of Biloxi. It is part of the Pascagoula, Mississippi Metropolitan Statistical Area. The population was 17,225 at the 2000 census.

, agrees that premises owners join a new generation of asbestos defendants. As more and more defendants declare bankruptcy, Luckey and his colleagues have begun looking to nontraditional defendants.

Luckey recently filed suit against about 20 companies in Mississippi that supplied asbestos-filled plastic pellets to manufacturers for use in consumer and industrial products. The plaintiffs in the suits, workers at industrial sites who handled the pellets, claim that the plastic can release dangerous dust.

"With all the bankruptcies, you have difficulty in getting recoveries from some of these folks," Luckey said. "This is about getting the entire exposure picture rather than just part of it."

Congress is currently considering a number of proposals to address the issue.
