5 FACING CHARGES IN SPILL; '93 EDWARDS INCIDENT LEADS TO INDICTMENTS.

A federal grand jury indicted INDICTED, practice. When a man is accused by a bill of indictment preferred by a grand jury, he is said to be indicted.  five executives and employees of two construction companies accused of conspiring against the government in connection with a 1993 fuel spill.

The jury in Fresno handed down indictments against an executive and three workers for a Delaware construction company and an executive from its Texas subcontractor, blamed for the rupture of a $1.8 million underground pipeline they built at Edwards Air Force Base Edwards Air Force Base, U.S. military installation, 301,000 acres (121,805 hectares), S Calif., NE of Lancaster; est. 1933. It is one of the largest air force bases in the United States and has the world's longest runway. .

Indicted were Benjamin Tinsdale III, chairman of the board and chief executive officer of Martech USA, now bankrupt; Martech employees William Nicholson There have been several well-known people named William Nicholson, including:

  • William Nicholson (naval officer) (1800–1872) 19th century U.S.
, Daniel Scales and Dennis Craft; and Richard Bender II, an officer of Thermacor Inc.

The indictment claimed that Martech was hired by Edwards Air Force Base in September 1991 to lay a pipeline between a fuel storage tank and a pump house but failed to adhere to adhere to

``Specifically, problems included negligently cutting into an existing fuel line, failing to pay subcontractors, failing to maintain required technical personnel on site, failing to construct a new pipeline to specifications, and failing to meet contract schedule deadlines,'' the indictment stated.

Beginning in May 1993, Edwards personnel complained of repeated alarms from the pipeline's leak detection system, and Martech was called back to make repairs.

On Nov. 13, 1993, the fuel line ruptured, causing what the indictment described as a massive fuel spill. Base officials and federal prosecutors were unable to provide a specific figure on the amount of fuel that leaked.

An investigation showed that Martech cut holes in the fuel line to retrieve faulty parts of the leak detection system, then patched them up and installed resistor devices to circumvent the leak warning system, according to according to
