3D Systems Files Counterclaim Against Vantico.

) today announced that it filed a counterclaim on Sept. 4 against Vantico International SA and its subsidiary, Vantico Inc., in the previously announced arbitration initiated by Vantico.

In the counterclaim, 3D Systems asserts that as a result of the Aug. 19, 2001 termination of the 1990 Research and Development Agreement with Ciba-Geigy Ltd., after Feb. 18, 2002, Vantico will not be allowed to sell, directly or indirectly, certain stereolithography The first 3D printing technology, which was pioneered by Chuck Hull of 3D Systems. Specifically, 3D Systems is asking the International Chamber of Commerce to enjoin To direct, require, command, or admonish.

Enjoin connotes a degree of urgency, as when a court enjoins one party in a lawsuit by ordering the person to do, or refrain from doing, something to prevent permanent loss to the other party or parties.
 any sales by Vantico, before Feb. 19, 2005, of the following: hybrid SL resins, including the entire family of Cibatool SL 5170 resins (SL 5170, SL 5180, SL 5190 and SL 5195); any SL resin that uses the additive BDMA BDMA British Damage Management Association

3D Systems believes that these represent the majority of resins developed and enhanced by 3D Systems for its SLA (1) (StereoLithography Apparatus) See 3D printing.

(2) (Service Level Agreement) A contract between the provider and the user that specifies the level of service expected during its term.
(R) product line and that its proprietary information is pervasive in a substantial portion of Vantico's products currently being manufactured, as well as those under development. As a result, 3D Systems believes that Vantico would be prevented under the terms of the Research and Development Agreement from separately marketing those products, unless the companies reach a subsequent agreement.

A separate agreement between 3D Systems and Vantico covers the distribution of resins in the Japanese market, and this will remain in effect until November 2002.
