3D FILES SUITS FOR PATENTS.

Byline: Daily News

VALENCIA - 3D Systems Corp. of Valencia filed two lawsuits last week seeking to protect the patents used in its technology - creating three- dimensional models from computer images.

The first action was filed in U.S. District Court in Texas against Advanced Manufacturing Engineering Manufacturing engineering

Systems of Nevada, Iowa Nevada is a city in Story County, Iowa, United States. The population was 6,658 at the 2000 census. It is the county seat of Story CountyGR6. It is also part of the 'Ames, Iowa Metropolitan Statistical Area', which is a part of the larger 'Ames-Boone, . 3D Systems asserts that AMES is infringing on 3D Systems' patents by using laser-sintering powder materials supplied by a German company, Electro Optical Systems GmbH and its subsidiary, EOS Eos (ē`ŏs), in Greek religion and mythology, goddess of dawn; daughter of the Titans Hyperion and Theia. 3D Systems' patents prohibit the use in the United States of EOS powder materials in its systems and those previously sold by Texas-based DTM DTM

``We believe we have overwhelming evidence to document our claims of patent infringement patent infringement n. the manufacture and/or use of an invention or improvement for which someone else owns a patent issued by the government, without obtaining permission of the owner of the patent by contract, license or waiver.  by AMES,'' Brian K. Service, 3D Systems' president and chief executive officer, said in a statement.

In the ongoing EOS v. DTM/3D Systems action in Federal District Court in California, 3D Systems filed a motion seeking a preliminary injunction A temporary order made by a court at the request of one party that prevents the other party from pursuing a particular course of conduct until the conclusion of a trial on the merits.

to force EOS to stop selling the laser-sintering powders in the United States.

``We intend to vigorously defend our patent rights in the U.S. and abroad to prevent misuse of our intellectual property such as this,'' Service said.

The point of contention is whether EOS can sell products produced by DTM before last year's merger.

``Contrary to public statements by EOS, 3D Systems remains fixed in its opinion that EOS does not have any rights to DTM patents and licensed rights, all of which were acquired by 3D Systems in the acquisition of DTM,'' Service said. ``The fact remains that EOS does not have the right to sell laser-sintering systems in the U.S.''
