Although Homeplace has promised to maintain three-fourths of the 17-acre site for public use, Councilman Jack Weiss Jack Weiss, is a member of the Los Angeles City Council representing the 5th district. Weiss was elected in 2001 and reelected in 2005. The 5th district includes parts of the Westside and the San Fernando Valley.  said he supports the community in opposing the project and vowed to do all he could to preserve the club.

The developer needs a zoning change to complete the project, which requires City Council approval.

``My first job is to make it clear to the owner of the property and the developer that the development on the table is a nonstarter,'' Weiss said Thursday. ``It's unacceptable, and it will encounter fierce community and political opposition.''

However, Guy Weddington McCreary, one of eight Weddington family members who own the land, said his family has the right to make a profit on its investment. The family hopes to sell the property to Homeplace for $12 million when the Golf and Tennis Club's lease expires in April 2005.

Nearly a half-century ago, the club signed a 50-year, $1,000-per-month lease on the property - a bargain by today's standards.

``The deal to keep most of the property for open space is the best the city is going to see,'' McCreary said. ``The problem is the Studio City Residents Association doesn't care about private property rights and the councilman has sold out to this interest.''
