SOUTHWALL TECHNOLOGIES INC. (Nasdaq: SWTX -news) 4/26/00 - 8/1/00: The Complaint charges Southwall and certain of its officers and directors with violations of the Securities Exchange Act of 1934. Southwall designs and produces thin film coatings that selectively absorb, reflect, or transmit electromagnetic radiation. The Company's products are sold to the architectural, automotive, and electronics markets. On August 1, 2000, Southwall announced that the Company will restate its first quarter 2000 financial statements as a result of accounting misstatements that will require "revisions in the value of inventory, particularly work in process, based on recording errors that affected the book value of raw materials and work in process, as well as errors in the application of cost standards to the work in process." On these and other shocking disclosures, trading in Southwall was halted, after last trading at $6-1/2 on August 1, 2000.

MERCATOR SOFTWARE (NASDAQ: MCTR - news) 4/20/00 - 8/21/00: The complaint charges that Mercator improperly overstated its gross profits and net income during the Class Period, while understating its operating expenses. As a result, the company restated its results for first quarter of 2000 and adjusted previously reported results for the second quarter. The news became public after stock markets had closed on August 21, when Mercator disclosed that it restated and lowered first- and second-quarter 2000 earnings to account for approximately $2.4 million of underreported expenses. The company also announced that it had accepted the resignation of its chief financial offer and fired its vice president of finance. In addition, Mercator said it retained an outside auditor to recommend "enhancements" to its financial infrastructure and internal controls.

IXL ENTERPRISES, INC. (NASDAQ:IIXL-news) 2/2/00-9/1/00: The Company is alleged to fail to disclose that it was experiencing a slowdown in growth and as a result would miss revenue expectations in the 3rd quarter.

LERNOUT & HAUSPIE SPEECH PRODUCTS, N.V. (NASDAQ:LHSP -news) 12/28/99-8/7/00: The Complaint alleges that the company misled investors about its business and financial results by overstating and creating false sales in Korea.

SYKES ENTERPRISES, INC. (NASDAQ: SYKE- news) 2/7/00-9/18/00: The Complaint alleges that the Company failed to inform investors of the need to restate its previously reported financial results for the year ended 12/31/99. As a result, the price of the Company's stock was artificially inflated.
