$60 Million Claim, Conspiracy, Xoom Executives, and Sub-Distributors to be Added to Copyright Infringement Suit Against Xoom.com.

RICHMOND, Va.--(BUSINESS WIRE)--Dec. 15, 1998--Imageline, Inc., a privately held developer of electronic clip art, has filed papers asking to amend its pending Copyright Infringement, False Advertising, and Unfair Competition lawsuit against Xoom.com, Inc. (Xoom) of San Francisco, California, to add Xoom executives, a claim for Conspiracy, and to seek in excess of $60,000,000 in damages.

Imageline claims that Xoom, its "sub-distributors", and "co-brand partners", have infringed Imageline's registered copyrights to thousands of original clip art illustrations and software files by including unlicensed copies of Imageline images in retail software packages, and by making them available on various Internet sites. Also named were Xoom sub-distributors Aztech New Media of Ontario, Canada and Media Graphics International of Arvada, Colorado.

Imageline is seeking an injunction against all software products and web sites that are displaying or distributing the illegal copies of Imageline software made available by Xoom, over $60,000,000 in compensatory damages, and punitive damages against Xoom, Xoom's Chairman Chris Kitze, and CEO Laurant Massa.
