``The procedure is, if they are intoxicated, to clear them medically,'' Quinn said. ``What we want is for a doctor to determine the source of intoxication and then treat them.''

Quinn said he was unfamiliar with the Olden case and thus could not comment on it.

In a memo to the claims board, County Counsel Robert Ambrose said that sheriff's deputies who arrested Olden noted in their report that he was extremely intoxicated.

According to documents in the case, Olden displayed bizarre behavior during nearly three days in jail, which the jailer's manual describes as cause for medical attention and transfer to a hospital.

``The jailers violated several provisions of the Sheriff's Department's manual regarding the handling, observation, control and treatment of extremely intoxicated inmates by not transferring him to a hospital the day of his arrest,'' Ambrose wrote in his memo.

``The failure of the jailers to follow the provisions of the Sheriff's Department's manual for the safety and handling of the extremely intoxicated inmates and their failure to transfer John Olden Jr. until his third day in custody led to the seizures which caused the death of John Olden Jr.''

Ambrose wrote that attorneys for the county believe a court would find the jailers were negligent and Olden's death could have been avoided.

Relatives said Olden was planning to take over and operate a family business before he died.
